Angola, IN/Golden, CO (PRWEB) March 23, 2011
Freda, Inc., Dual Cure, llc, and HP Spartacote Inc., are pleased to announce the successful defense of core patents in an intellectual property lawsuit.
Originally filed on December 29th, 2009 (Case 2:09-cv-02699-SRB, United States District Court for the District of Arizona), the patent infringement lawsuit was intended to protect US patents 6,833,424 & 7,169,876 involving formulations of high performance polyaspartic coatings. The patents provide for superior levels of durability, flexibility, adhesion, corrosion resistance, and chemical resistance, while dramatically reducing application times and costs.
Freda, Dual Cure, and HP Spartacote take the intellectual property rights of others seriously and enforces its own firmly. U.S. Patents Nos. 6,833,424 and 7,169,876, both of which are titled “Dual Cure Polyurea Coating Composition” and were the subject of recent litigation against PremierGarage Systems, LLC. The patent owners have settled their dispute with PremierGarage, llc, and retain the rights to enforce the patents.
“Above all, we always put our customers first." said Sean Shiers, president of HP Spartacote, Inc. "The agreement to settle with Premier Garage ensures that our customers will have the highest level of certainty and protection when using HP Spartacote products. We are very proud to have licensed these intellectual property assets. We believe it is imperative to vigorously defend our core intellectual property to ensure that other manufacturers do not compromise the integrity or the quality of our products.”
According to Dave Harmon Jr., president of Baril
Coatings USA (the affiliated manufacturing entity of Freda, Inc.) “The
settlement reflects and enhances the strength of the intellectual property
derived from the patents in the field of high performance coatings.” “Our
company and affiliated industry partners invest millions of dollars annually in
the development of new products.” “A failure to protect the intellectual
property that stems from those efforts would prevent all of us from continuing
to create new breakthrough technology and coating systems. “We remain confident
in our strategy to protect the intellectual property rights in our coatings and
expect to continue broadening the scope of our patent enforcement
program.”
